These Terms of Use govern access to and use of the website aelysium-softworks.com (hereinafter, the "Service"), provided by ÆLYSIUM Softworks, located in Italy. By using the Service, the user fully accepts these Terms.

• "User": any natural or legal person who accesses the website or uses the platform.
• "Provider": ÆLYSIUM Softworks, provider of the Service.

2. Subject of the Service

ÆLYSIUM Softworks provides a website with the purpose of company portal that allows users to:

• Contact the provider.
• Subscribe to the mailing-list of the provider to updates on new products, and/or product patches, and/or new blog articles.

3. Terms of Use

The user agrees to use the Service in compliance with applicable laws and these Terms. The following is prohibited:

• Using the Service for illegal or unauthorized purposes.
• Attempting to access data of other users.
• Interfering with the operation of the Service or its security systems.
• Transmitting harmful, defamatory, offensive content.
• Performing reverse engineering, decompilation, or disassembly of the software

4. Intellectual Property

All intellectual property rights related to the Service, including software, design, trademarks, logos, and content, are the exclusive property of the Provider or its licensors.

The user retains ownership of all content and data uploaded to the platform (documents, customer information, configurations). The Provider does not acquire any ownership rights over user data.

The user grants the Provider a limited license to process their data solely for the purpose of delivering the Service.

5. Service Availability

The Provider endeavors to ensure Service availability with reasonable continuity but does not guarantee uninterrupted or error-free operation. The Service may be temporarily suspended for:

• Scheduled or emergency maintenance.
• Platform updates and improvements.
• Force majeure events.
• Technical issues with infrastructure providers.

6. Limitation of Liability

To the extent permitted by applicable law:

• The Service is provided "as is" and "as available".

Regarding end-customer data entered by the user into the platform, the Provider acts as Data Processor under Art. 28 of the GDPR, while the user remains the Data Controller for their business data.

10. Withdrawal and Cancellation

The user may cancel their mailing-list subscription at any time by following the mailing-list subscription and clicking on the "Erase the subscription" button, or alternatively contacting the Provider through the contact form. Following cancellation:

• User data will be deleted right away if done by the mailing-list subscription or within 30 days if the request occurs through the contact page.

11. Changes to Terms

The Provider reserves the right to modify these Terms at any time. Changes will be communicated through publication on this page. Continued use of the Service after publication of changes constitutes acceptance of the new Terms.

12. Governing Law and Jurisdiction

These Terms are governed by Italian law. For any dispute relating to the interpretation, execution, or termination of these Terms, the competent court is that of Catanzaro, Italy, unless otherwise provided by mandatory consumer protection law.
